Measuring up to the California Anti-Spam Law

The California Anti-Spam law came in to effect from January 1, 2004.
The law prohibits sending of unsolicited email advertisements by any
email marketer.

According to the Law, it is illegal to send email to some one:

  • With whom you do NOT have an existing transactional relationship and
  • Who has NOT given you direct consent to contact

It applies to any email address used by a resident of (or accessed from) California.

ASP
conducted a survey, to see how support organizations plan to deal with
this new law. The graph below shows the survey results.

makes email marketing a tough nut to crack for most marketers,
especially the Software marketers of Silicon Valley, which is the heart
